Cherry Forge, LLC (“Ornamental Entries”, “we”, “our”, or “us”) is a leading provider to its customers (“Customer(s)”, “purchaser”, “your” or “you”) of top-quality ornamental doors. Customer satisfaction is priority number one. We set out to provide our clients with high-quality products and outstanding customer service. Before placing an order through our website please review the following terms and information. By purchasing our Product, you agree to be bound by these Product terms and conditions (“Terms and Conditions”):
1. GENERAL PRODUCT INFORMATION.
All Ornamental Entries doors are manufactured by hand in Tempe, Arizona. Due to the fact that all of our products are handmade, final product dimensions in regard to product width, height, hinge, plunger and deadbolt locations ordered may vary within 0.125 of an inch. These minor differences in dimensions may occur and are to be considered acceptable by you. These tolerances are within industry standard.
Any Ornamental Entries doors can be expected to naturally age due to exposure to natural elements and frequent use of product(s). Any resulting depreciation, damages or changes to the product(s) as a result of frequent use or exposure to the elements are considered normal, not defective and are not covered under our Terms and Conditions.
We reserve the right, in our sole and absolute discretion, to make changes in manufacturing specifications and product designs at any time without any prior notice and without incurring any obligations.
2. WARRANTIES AND DISCLAIMERS.
Certain warranties are provided by Ornamental Entries on doors purchased through our website. These warranties are subject to restrictions, exclusions and limitations as provided herein. Please review our warranties, exclusion, limitations and restrictions prior to purchase.
The warranties provided herein do not include, and Ornamental Entries will not be held responsible for, the provision and/or costs relating to labor and materials, including, but not limited to the following:
a) The process of uninstalling and/or re-packaging of Product for return to Ornamental Entries.
b) The reinstallation of new or replacement Product(s).
The limitations stated above will be the sole and absolute responsibility of the Customer.
Limited Warranty:
Ornamental Entries warrants and guarantees its doors shall remain free from rust or defects in assembly, structural integrity of the door shell, design and book hinges for a period of (2) years from the date of delivery.
Powder coat Warranty:
Ornamental Entries warrants that its powder coat adhesion will last and be free from flaking or peeling for a period of one (1) year from the date it was delivered. If powder coat is deemed defective within this period Ornamental Entries will repair or replace product free of charge.
Customer acknowledges and concurs that the subsequent are not considered defects in powder coat finish and shall not be covered by warranty:
a) The natural occurrence of Fading or weathering
b) Any product that has been modified after delivery, impacted by foreign objects or damaged during unloading.
c) Any distortion in finish due to the application of foreign chemicals and/or hose water in any capacity.
Glass Warranty:
Ornamental Entries warrants the assembly of its glass and seal to be free from failure for a period of (1) year from the date it was delivered and will replace glass panel free of charge if seal failure occurs within the stated period.
Customer acknowledges and concurs that the subsequent are not considered defects in glass and shall not be covered by warranty:
a) Any damage after delivery including but not limited to scratches, fragmenting or seal failure resulting from cleaning with foreign chemicals.
Claims:
To initiate a warranty claim for an alleged defect that falls within the specified warranty period, you will be required to provide images and a concise description of product defect(s) to us via email at info@ornamentalentries.com through our website. Our customer service department will review the information you provide and determine, in its sole and absolute discretion, whether your warranty claim is covered by our warranty policy as provided herein. The date of defect will be determined by Ornamental Entries and in no circumstance shall precede the date the customer first advised Ornamental Entries through email of any defect. In the event our Customer Service Department concludes that your described defect is covered by a certain warranty provided herein, we will replace such inadequate product(s) or related hardware that have been determined defective by our customer service department.
3. EXCLUSIONS AND LIMITATIONS
Ornamental Entries warranties exclude and specifically do not cover the following:
a) Damage or failure including but not limited to fire, excessive moisture, any act of nature, abuse, criminal activity, misuse, neglect or vandalism.
b) Any lock or lever hardware installed by customer.
c) Issues or product failure resulting from the customers installation process or faulty construction.
d) Normal wear due to use of window hardware, hinges or weather stripping.
e) Bug screen(s) or vinyl door sweep(s).
f) Any contact with corrosive elements.
g) Improper cleaning, maintenance or care.
4. BUILDING CODES.
Ornamental Entries does not make any representations that Products purchased from our website fulfill building code requirements, ordinances, or regulations for any specific application or any particular jurisdiction. Ornamental Entries is not responsible for any orders or Products that do not pass any city or state code requirements. It is the sole responsibility of the Customer to ensure that the Products purchased from Ornamental Entries conform to the applicable local building codes and regulations.
5. EXPRESS LIMITED WARRANTY.
a) Cherry Forge LLC and/or Ornamental Entries express limited warranty sets forth our maximum liability for our Products. Under no circumstance is anyone authorized to modify, change or expand this express limited warranty.
b) Cherry Forge LLC and/or Ornamental Entries shall not be liable for any inadequate substrates, faulty construction or structural deficiencies affecting product(s) performance. Cherry Forge LLC and/or Ornamental Entries shall not be liable for any injury, death, or other claim arising out of Customer’s installation or use of any Product, including without limit, claims for personal injury, wrongful death, punitive damages, or other tort claims of any kind. Customer assumes the cost and risk of installation and use of all Products, including without limit, any failure or deterioration of the mounting surfaces, such as splitting, collapsing, sinking, warping, sagging or settling, and any other damage to Customer’s property or the installation site. Customer’s exclusive remedy against Cherry Forge LLC and/or Ornamental Entries, and Cherry Forge LLC and/or Ornamental Entries sole obligation for any and all claims, whether for breach of contract, warranty, tort (including negligence) or otherwise, shall be limited to Cherry Forge LLC and/or Ornamental Entries replacing defective Products or, at Cherry Forge LLC and/or Ornamental Entries preference, refunding the purchase price. In no event shall Cherry Forge LLC and/or Ornamental Entries have any liability for damages in an amount exceeding the purchase price of the goods sold hereunder, nor shall Cherry Forge LLC and/or Ornamental Entries have any liability for incidental, consequential, or punitive damages.
c) In the event state or provincial law precludes exclusion or limitation of implied warranties, the duration of any such warranties shall be no longer than, and the time and manner of presenting any claim thereon shall be the same as, that provided in the express warranty stated herein.
6. INDEMNITY. Customer agrees to indemnify, defend and hold CHERRY FORGE LLC AND/OR ORNAMENTAL ENTRIES and its members, managers, employees, contractors, agents, representatives, and affiliates harmless from and against any and all liability, claims, losses, costs, and expenses including but not limited to attorneys’ fees that arise from the Customer’s violation or breach of these Terms and Conditions.
7. TITLE AND RISK OF LOSS. Title and risk of loss for all Cherry Forge LLC and/or Ornamental Entries Products passes to the Customer. Any and all loss or damage that occurs after title of Product passes to the Customer is the sole responsibility of Customer.
